Assessment Services

Nature of Assessments

All assessments provided through our protocol are:

• Curatorial opinions based on the Mend Index protocol methodology
• Not financial appraisals, valuations, or investment advice
• Subject to assessor judgment and protocol parameters
• Not guarantees of authenticity or provenance

Assessment Finality

Once an assessment is signed by an assessor, it becomes immutable and cannot be edited. Scores represent the assessor's opinion at the time of evaluation.

Artwork Submissions

Submission Requirements

By submitting artwork, you:

• Confirm you are the creator or authorized representative
• Grant us a non-exclusive license to display submitted images
• Accept that assessments are curatorial opinions, not valuations
• Acknowledge your right to request removal via takedown process

Content Guidelines

Submitted content must not violate any copyright, trademark, or intellectual property rights. We reserve the right to remove content that violates these guidelines.

Ownership Claims

When filing an ownership claim:

• You must provide accurate and truthful information
• Evidence must support your relationship to the artwork
• Claims are reviewed by administrators
• False claims may result in account suspension

Assessor Responsibilities

Assessors agree to:

• Evaluate artworks based solely on material and contextual evidence
• Not reference market prices or auction results
• Maintain confidentiality of internal assessment notes
• Follow the protocol methodology consistently

Intellectual Property

All content on this website, including the assessment protocol, scoring methodology, and interface design, is the property of Bayview Hub or its licensors and is protected by copyright and intellectual property laws.

User Conduct

You agree not to:

• Use our services for any unlawful purpose
• Submit false or misleading information
• Attempt to manipulate assessment scores
• Interfere with or disrupt our systems
• Attempt to gain unauthorized access

Limitation of Liability

To the fullest extent permitted by law, Bayview Hub and its operators shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services. Assessments should not be relied upon for financial decisions.

Takedown Requests

If you believe content on our platform infringes your rights, you may submit a takedown request. We will review all requests and take appropriate action in accordance with applicable law.

Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to the website. Continued use of our services constitutes acceptance of modified terms.

Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Victoria.
